Terms of Service

Article 1 (General Provisions)

These Terms of Service (hereinafter "these Terms") set forth the conditions of use for TrendPackage and all associated services (hereinafter "the Service") provided by LillyHoldings, Inc. (hereinafter "the Company"). All users of the Service (hereinafter "Users") shall be deemed to have agreed to these Terms.

Article 2 (Service Description)

The Service includes AI-powered web customer acquisition diagnostics for stores and businesses, provision of diagnostic reports, and related consulting services. The Company may change, add to, or discontinue the content of the Service without prior notice to Users.

Article 3 (Prohibited Actions)

Users shall not engage in any of the following actions when using the Service.
  1. Unauthorized access or attempted unauthorized access to the Service systems
  2. Placing excessive load on servers or networks
  3. Actions that interfere or may interfere with the operation of the Service
  4. Accessing the Service using automation tools, bots, scrapers, or similar means
  5. Reverse engineering, decompiling, disassembling, or otherwise analyzing the Service
  6. Inputting false information
  7. Using the Service by impersonating a third party
  8. Selling, redistributing, publishing, or commercially using diagnostic results, reports, or data obtained through the Service without prior written consent from the Company
  9. Imitating or copying all or part of the Service to provide similar services to third parties
  10. Using the Service to unlawfully obtain trade secrets of competitors
  11. Actions that violate laws or public order and morals
  12. Other actions reasonably deemed inappropriate by the Company

Article 4 (Detection and Response to Unauthorized Use)

The Company records and retains IP addresses, access logs, operation histories, and other technical information of Users for the proper operation of the Service. If unauthorized use or violation of these Terms is confirmed, the Company may take the following measures.
  1. Restriction or suspension of Service use
  2. Claim for damages arising from the violation
  3. Legal action (including civil and criminal proceedings)

The Company may provide IP addresses, access logs, and other technical information to law enforcement agencies to the extent necessary for investigating unauthorized use.

Article 5 (Intellectual Property Rights)

All intellectual property rights relating to content included in the Service (text, images, logos, trademarks, software, algorithms, diagnostic logic, etc.) belong to the Company or their rightful owners. Users shall not reproduce, modify, distribute, or publicly transmit such content without prior written consent from the Company.

Article 6 (Disclaimer)

  1. Diagnostic results from the Service are automated AI analyses, and the Company makes no guarantees regarding their accuracy, completeness, or usefulness. Users are responsible for their own business decisions and other determinations.
  2. The Company assumes no liability for damages incurred by Users due to interruption, suspension, modification, or discontinuation of the Service.
  3. The Company does not guarantee that the Service does not infringe upon the rights of third parties.

Article 7 (Damages)

If a User violates these Terms and causes damage to the Company or third parties, the User shall be liable for such damages (including attorney fees). In particular, for violations of Article 3, Items 8 and 9, the Company shall claim damages including lost profits.

Article 8 (Usage Restrictions)

The Company may restrict or suspend use of the Service without prior notice to Users in any of the following cases.
  1. When these Terms have been or may be violated
  2. When a large number of requests are sent from the same IP address in a short period
  3. When excessive diagnostic requests for the same email address are detected
  4. When the Company otherwise deems it inappropriate for Service operation

Article 9 (Amendments to Terms)

The Company may amend these Terms as necessary. The amended Terms shall take effect upon publication on this page, and Users who use the Service after the amendment shall be deemed to have agreed to the amended Terms.

Article 10 (Governing Law and Jurisdiction)

The interpretation and application of these Terms shall be governed by the laws of Japan. Any and all disputes relating to these Terms shall be subject to the exclusive jurisdiction of the Nagoya District Court as the court of first instance.
